Declarations of Disclosable Pecuniary and Non Disclosable Pecuniary/Other Interests

Minutes:

The Chairman, on behalf of Members and Officers present at the meeting, declared a general non disclosable pecuniary/other interest in respect of items related to the setting of the Council Tax for 2017/2018. 

 

(In accordance with Council Procedure Rule 30.1, Councillor Cheryl Butler moved suspension of Council Procedure Rule 23 [Conclusion of Proceedings] to enable the meeting to continue beyond 9.15 p.m. should this be necessary in order for the Council to give proper consideration to the determination of its budget.  Having been duly seconded and voted upon, Council agreed with this course of action.)

General Fund Revenue Budget 2016/17 and 2017/18

Minutes:

Council was requested to approve the General Fund Revenue Estimates for 2016/17 (Revised) and for 2017/18, as per the recommendation from the meeting of the Cabinet held on 20th February, 2017.

 

Councillor Jason Zadrozny, seconded by Councillor Ben Bradley, moved an amendment to the recommendation in the form of an alternative Revenue Budget for 2017/18 (as circulated).  To enable Council Members to consider the amendment, the meeting was adjourned at 7.19 p.m. for a period of 15 minutes.

 

The meeting reconvened at 7.34 p.m.

 

(In accordance with Council Procedure Rule 30.1, Councillor Ben Bradley moved suspension of Council Procedure Rule 16.4 [Content and Length of Speeches] to enable Members to speak freely on the budget and tax setting items as presented. Having been duly seconded and voted upon, the proposed suspension was lost.)

 

Following a lengthy debate, the amendment to the recommendation was put to the vote and duly lost.

Members’ attention is drawn to the following item of business which contains a specific recommendation to the Council:-

 

Minute No. CA.85 which deals with the level of Ashfield District Council Band “D” Council Tax for 2017/18 (draft Council Tax Resolution also attached).

Minutes:

Council received the minutes (as circulated) from the Extraordinary Cabinet meeting which was held immediately prior to the Extraordinary Council meeting. In addition Members were also furnished with a copy of the 2017/18 Council Tax resolution document.

 

The Chairman adjourned the meeting at 8.42 p.m. to enable Members to read the documents as circulated.

 

The meeting reconvened at 8.44 p.m.

 

Having been fully debated, the recommendation was put to the vote and it was

 

RESOLVED

that the Council Tax levels for 2017/18 on the basis of a Band “D” tax level for the District Council’s own expenditure of £180.46 (£5 increase), be approved as follows:-

 

1.    That it be noted that on 13 January 2017 the Council calculated the Council Tax Base for 2017/18

 

a.    for the whole Council area:  32,546.2

 

b.    for dwellings in those parts of its area to which a Parish precept relates –

 

The Parish of Annesley and Felley:  533.3

The Parish of Selston:  3,661.5

 

2.    That the calculation of the Council Tax requirement for the Council’s own purposes for 2017/18 (excluding Parish precepts) is £5,873,287

 

3.    That the following amounts be calculated  for the year 2017/18 in accordance with Sections 31 to 36 of the Act:

 

(a)

£72,288,630

 

being the aggregate of the amounts which the Council estimates for the items set out in Section 31A(2) of the Act taking into account all precepts issued to it by Parish Councils.

 

(b)

£66,130,593

 

being the aggregate of the amounts which the Council estimates for the items set out in Section 31A(3) of the Act.

 

(c)

£6,158,037

 

being the amount by which the aggregate at 3(a) above exceeds the aggregate at 3(b) above, calculated by the Council in accordance with Section 31A(4) of the Act as its Council Tax requirement for the year.

 

(d)

£189.21

 

being the amount at 3(c) above,  divided by 1(a) above, calculated by the Council, in accordance with Section 31B of the Act, as the basic amount of its Council Tax for the year (including Parish precepts).

 

 

(e)

£284,750

 

being the aggregate amount of all special items (Parish precepts) referred to in Section 34(1) of the Act (as per the tables below).

 

(f)

£180.46

 

being the amount at 3(d) above less the result given by dividing the amount at 3(e) above 1(a) above), calculated by the Council, in accordance with Section 34(2) of the Act, as the basic amount of its Council Tax for the year for dwellings in those parts of its area to which no Parish precept relates.

 

 

To note that Nottinghamshire County Council, the Nottinghamshire Police & Crime Commissioner and the Nottinghamshire Fire and Rescue Authority have issued precepts to the Council in accordance with Section 40 of the Local Government Finance Act 1992 for each category of dwellings in the Council’s area as indicated in the table below.

Minutes:

Council was requested to approve the proposed changes to the Financial Regulations of the Council as presented.

 

RESOLVED

that the changes to the Financial Regulations of the Council, as outlined in the report, be approved.

 

Reason:

The amendments will allow officers to progress the Commercial Enterprise Strategy with greater flexibility.
