1.         Application V/2016/0737, Chardstock Management Services Limited, outline application for the erection of 24 one and two bedroom apartments and associated works, land at junction of Outram Street and Park Street, Sutton in Ashfield.


It was moved and seconded that that planning permission be refused for the following reasons:-


1.  The Town and Country Act 1990, Section 106 allows a local planning authority to enter into a legally-binding agreement or planning obligation with a landowner in association with the granting of planning permission. These agreements are a way of delivering or addressing matters that are necessary to make a development acceptable in planning terms.  The applicant refuses to enter into a Section 106 Agreement, the terms of which were confirmed in advance of the presentation of the application to the initial planning committee for determination.  Accordingly, in the absence of the contributions requested, the development is considered to be unsustainable, failing as it would to contribute towards local facilities, infrastructure and services considered necessary to mitigate against the impacts of the proposed development.


2.    The proposed development, without the satisfactory completion of the Section 106 Agreement, is considered to be contrary to Policy HG4 of the ALPR 2002, the ADC SPD – Affordable Housing 2009 and HG2 of the ALP Publication 2016 in it’s failure to meet the affordable housing provision; contrary to Policy HG6 of the ALPR 2002 and HG3 of the ALP Publication 2016 in it’s failure to secure off-site open space and public realm improvements; and contrary to Policy PJ5 of the ALP Publication 2016 and Paragraph 72 of the NPPF in it’s failure to provide an education contribution for primary school places in the locality.


2.         Application V/2017/0571, Ashfield District Council, alterations to the external façade including new cladding, new windows and doors, Kingsmill Reservoir, Sherwood Way South, Sutton in Ashfield.


(At this point in the proceedings Councillor Cheryl Butler declared that she was predetermined in respect of this application.  Her interest arose from the fact that she had recently attended the launch of the Kingsmill Reservoir Visitors Centre and also taken part in a radio interview promoting the virtues of this facility.  Councillor Butler therefore left the room at 6.42 p.m. and took no part in the discussion and voting thereon).


It was moved and seconded that conditional consent be granted.


(Councillor Butler returned to the room at 6.47 p.m. following consideration of the above application).


3.         Application V/2017/0589, Ashfield District Council, installation of external wall insulation and new external doors and windows to 78 dwellings, various properties at Story Gardens, Arden Close and Bestwood Road, Hucknall.


(At this point in the proceedings Councillor Keir Morrison declared a Non Disclosable Pecuniary/Other Interest in respect of this application in his capacity as the Cabinet Portfolio Holder for Housing and Assets.  In view of the nature of his interest he remained in the meeting and took part in the discussion and voting thereon).
