the following reasons:-
The Town and Country Act 1990, Section 106 allows a
local planning authority to enter into a legally-binding agreement
or planning obligation with a landowner in association with the
granting of planning permission. These agreements are a way of
delivering or addressing matters that are necessary to make a
development acceptable in planning terms. The applicant refuses to enter into a Section 106
Agreement, the terms of which were confirmed in advance of the
presentation of the application to the initial planning committee
for determination. Accordingly, in the
absence of the contributions requested, the development is
considered to be unsustainable, failing as it would to contribute
towards local facilities, infrastructure and services considered
